1 Introduction & Definitions

1.1 About these Terms & Conditions

These Terms and Conditions (‘T&C’) are effective from 20 November 2017. The information set out in these T&C is relevant to all gamerascal.co.uk website users including but not limited to buyers and sellers.

1.2 Agreement

Please read these Terms and Conditions carefully before using the gamerascal.co.uk website (‘Website’). By using the Website, you signify your agreement to be bound by these Terms and Conditions.

If you disagree with any part of these Terms and Conditions, please do not use the Website. Unauthorised use of the Website may give rise to a claim for damages and/or be a criminal offence. If you do not understand any part of these Terms and Conditions, then please contact us before placing an order or making a sales enquiry.

GameRascal is under a legal duty to supply goods that conform to these Terms and Conditions.

GameRascal may change these Terms and Conditions from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

1.3 Who We Are and How to Contact Us

GameRascal is an e-commerce business specialising in Nintendo Game Boy products. We have been trading since 2011. Our correspondence address is 55 Swan Road, London SE16 7DY, United Kingdom. You can email us at customersupport@gamerascal.co.uk and sellersupport@gamerascal.co.uk. You may also contact us via any of the Website contact forms provided for this purpose.

1.4 Definitions

1.4.1 Specific words and phrases used in these Terms and Conditions shall have the following meanings unless otherwise stated:

Word or Phrase

Buyer

Any Private Individual who submits a completed Order.

Cart

That part of the Order which lists the Products selected by the Buyer.

Cash Payment A payment made by GameRascal to the Seller by cheque, bank transfer or PayPal only.

Collectable

Any Product listed in the ‘Collectables’ Product Category of the Website.

Counter-Proposal

A non-binding proposal made by GameRascal following receipt of the Goods by GameRascal. A Counter-Proposal overrides the original Sale Offer.

Dispatch Confirmation

An email sent by GameRascal to the Buyer confirming dispatch of the Products purchased by the Buyer.

Goods

Any Nintendo Game Boy or related item of a type that may from time to time be offered for sale to GameRascal by a Seller.

Inspection

An inspection of the Seller’s Goods by GameRascal.

Order

The Website order form at www.gamerascal.co.uk/cart.php to be completed with details relating to the Buyer and the Products and (once these Terms and Conditions have been read and understood in full) to be submitted by a Buyer.

Order Acknowledgement

An email sent by GameRascal to the Buyer confirming receipt of the Buyer’s Order. The Order Acknowledgement contains a unique Order Number.

Order Number

A number uniquely identifying the Buyer’s Order. This number can be found in the Order Acknowledgement.

Private Individual

An individual who seeks to buy Products or to sell Goods for the purpose of personal profit only and does not seek either directly or indirectly through a Purchase or a Sale to derive a profit or other commercial gain for a business.

Product

Any Nintendo Game Boy or related item of a type that may from time to time be offered for sale by GameRascal.

Product Category

A group of related Products which is represented in the ‘Browse by Model’ navigation box displayed on some Website pages.

Product Description

That part of the website where information related to an individual Product is provided.

Purchase

The purchase by a Buyer of Products from GameRascal.

Purchase Contract

A contract between a Buyer and GameRascal for the purchase of GameRascal’s Products.

Quotation

A non-binding valuation (inclusive of VAT where applicable) of the Seller’s Goods, provided by GameRascal.

Required Specifications

The specifications set out in Condition [7.5].

Returns Fee

The fee charged by GameRascal to the Seller for returning the Goods back to the Seller.

Returns Reference Number

A number provided by GameRascal to the Buyer which uniquely identifies and authorises the Buyer’s request to return Products to GameRascal.

Sale

The sale by a Seller of Goods to GameRascal.

Sale Contract

A contract between a Seller and GameRascal for the sale of the Seller’s Goods.

Sale Offer

Has the meaning set out in Condition [7.2.5].

Sales Enquiry

The form on the Website page at www.gamerascal.co.uk/sell/contact.php to be completed with details as requested on the Website page at www.gamerascal.co.uk/sell/salesenquiry.php and (once these Terms and Conditions have been read and understood in full) to be submitted by the Seller.

Sales Process

The process set out in Condition [7.2], which is only available to Sellers.

Seller

Any Private Individual who submits a completed Sales Enquiry.

Seller’s Information

Any information provided by the Seller to GameRascal prior to Inspection including, without limitation, personal information or information regarding Goods contained in a Submitted Sales Enquiry or provided to GameRascal over the telephone or otherwise.

Seller’s Payment Details

Any information provided by the Seller to GameRascal to enable payment by GameRascal to the Seller including, without limitation, bank account details or PayPal details or preferred method of payment.

Services

Without limitation, the services provided by GameRascal through or in connection with a contract.

Submitted Sales Enquiry

The Sales Enquiry submitted online to GameRascal by a Seller.

Submitted Order

The Order submitted online to GameRascal by a Buyer.

User

A user of this website.

We/us

GameRascal. “Our” shall be construed accordingly.

Website

The website located at www.gamerascal.co.uk or any URL which may replace it.

Working Day

Any day which is not a Saturday, a Sunday or a public holiday in England;

You/you

A user of this website. “Your” shall be construed accordingly.

1.4.2 In these Terms and Conditions, singular words shall include the plural and vice versa unless otherwise stated.

1.4.3 In these Terms and Conditions, a reference to one gender shall include a reference to the other genders; unless otherwise stated.

1.4.4 Headings are included in these Terms and Conditions for convenience only and shall not affect the construction or interpretation of these Terms and Conditions.

2 Copyright & Trademark Notice

2.1.1 The content and other matters related to the Website are protected under applicable laws relating to intellectual property rights, including but not limited to copyright and trademark laws. The copying, redistribution, use or publication by you of any such matters or any part of the Website, except as set out in these Terms and Conditions, is strictly prohibited.

2.1.2 Any redistribution or reproduction of part or all of the content of the Website in any form is prohibited other than the following:

2.1.2.1 you may print or download to a local storage device extracts for your personal and non-commercial use only;

2.1.2.2 you may copy the content to individual third parties for their personal use, but only if you acknowledge the Website as the source of the material.

2.1.3 GameRascal is a trademark of GameRascal. Other product and company names contained in the Website may be trademarks or service marks of their respective owners. GameRascal reserves all right, title and interest in and to its copyright and trademark rights.

3 Use of the Website

3.1 Access to the Website

3.1.1 We take reasonable steps to ensure that availability of the Website is uninterrupted and that transmissions are error-free. Due to the nature of the Internet, however, this cannot be guaranteed. Also, access to the Website may occasionally be suspended or restricted to allow for maintenance or to introduce new services or content.

3.2 Children

3.2.1 If you are under 18 years of age, you may use the Website only with the involvement of a parent or guardian. Adults may purchase Products for children as long as the Products purchased are intended by the manufacturer for use by children.

3.3 Indemnity

3.3.1 By your use of the Website you hereby indemnify us and undertake to keep us indemnified at all times now and in the future against all possible claims relating to any breach of these Terms and Conditions by you. Such indemnities to include (but not be limited to) all costs legal and otherwise, all other expenses, damages or settlements arising from your breach of these Terms and Conditions.

4 Privacy Policy

4.1 Introduction

4.1.1 GameRascal is committed to ensuring that your privacy is protected. This privacy policy sets out how GameRascal uses and protects any information that you enter via the Website or give us in any other way. Should we ask you to provide certain information by which you can be identified, then you can be assured that it will only be used in accordance with this privacy statement.

4.2 What we collect

4.2.1 We receive and may store any information you enter via the Website or give us in any other way. Here are the types of information we collect:

  • contact details including name, phone number and email address;
  • delivery information including address and postcode;
  • payment details (Sellers only) including bank sort-code and account number;
  • your preference to receive or not to receive direct marketing emails;
  • information about the type of browser you use;
  • your IP address and other Internet related settings;
  • anonymous statistics about how you use the Website.

4.3 What we do with the information we gather

4.3.1 We use the information to handle Orders and Sales Enquiries, deliver Products and Services, process payments, communicate with you about Orders, Sales Enquiries, Products, Goods, Services and promotional offers, update our records and generally maintain your details held by us, and display content such as Products & Services that might be of interest to you. We also use this information to improve the Website and Services, prevent or detect fraud or abuses of the Website and enable third parties to process your payment or carry out technical, logistical or other essential non-marketing functions on our behalf. Anonymous extracts from customer feedback may be used for marketing purposes.

4.4 What we do with your payment details

4.4.1 Buying from GameRascal: we neither collect nor store Buyers’ payment details. Instead, when the Buyer is ready to check-out, he will be automatically redirected to the secure website of our Payment Service Provider (Sage Pay) who will collect the necessary details from him. Buyers should refer to Sage Pay’s own privacy policy for details of the information it may collect and store.

4.4.2 Selling to GameRascal: we collect and store those details necessary to pay the Seller for his Goods (‘Seller’s Payment Details’). The Seller’s Payment Details are collected via email and are then stored in encrypted form in a secure environment.

4.5 Does GameRascal share your information with others?

4.5.1 We do not sell your information to others. We share your information only as described below. Information released to third parties is restricted to that required to perform specific functions and is processed only as permitted by the UK’s Data Protection Act.

4.5.1.1 Payments and Refunds: we share with our Payment Service Providers those Buyers’ and Sellers’ details necessary to receive and make payments relating to Orders and Sales Enquiries.

4.5.1.2 Delivery: we share your delivery details with delivery companies such as Royal Mail to deliver packages and other mail.

4.5.1.3 Protection of GameRascal and Others: we release personal information when we believe this is necessary to comply with the law; enforce or apply our conditions of use and other agreements; or protect the rights, property or safety of GameRascal, our users or others. This includes exchanging information with other companies and organisations for fraud prevention and credit risk reduction.

4.5.1.4 Improvement of products and services: we share with Google Analytics and others anonymous data regarding your use of the Website to help us improve our Services.

4.6 Security

4.6.1 We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place physical, electronic and managerial procedures to safeguard and secure the information we collect.

4.7 How we use cookies

4.7.1 A cookie is a small text file on your computer which allows a web application to store information and use it to respond to you as an individual. We use cookies to:

  • enhance your shopping experience;
  • enable you to share Website pages through various social networking sites and email;
  • provide anonymous statistical data to help us mould the Website to your needs.

4.7.2 Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This would prevent you from taking full advantage of the Website.

4.8 Controlling your personal information

4.8.1 You may choose to restrict the collection or use of your personal information in the following ways:

4.8.1.1 You can always choose not to provide information, even though it might be needed to make a purchase or a sale or take advantage of some website features.

4.8.1.2 If you have previously checked the ‘Remember me’ box during the checkout process to have your address details stored in a local cookie, you can remove such information by following the instructions in your browser’s Help system to delete the cookie.

4.8.1.3 You can refuse to accept cookies from the Website by following the instructions in the Help pages of your particular browser. This may prevent you from using some of the Website features.

4.8.1.4 You can choose not to receive direct marketing emails by leaving the ‘Allow Promotional Emails’ box unchecked on the checkout page. If you have previously chosen to receive direct marketing material, you can choose to stop receiving such material by clicking the Unsubscribe link contained in each marketing email we send you. Alternatively you can unsubscribe by contacting us.

4.8.1.5 You can prevent Google Analytics collecting anonymous visitor information by installing  Google’s browser opt-out Add-on.

4.8.1.6 You can choose not to have anonymous extracts from your feedback used in marketing materials by contacting us.

4.8.1.7 You can choose not to use the social icons (including but not limited to ShareThis; Facebook; Twitter & Email) found on some Website pages.

4.8.2 You may request details of personal information which we hold about you under the Data Protection Act 1998. An administrative fee of £5.00 will be payable. If you would like a copy of the information held on you please contact us.

4.8.3 If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible. We will promptly correct any information found to be incorrect.

4.9 Links to other websites

4.9.1 The Website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. We cannot, therefore, be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

5 Condition of Products Offered for Sale by GameRascal

5.1 Introduction

5.1.1 This section relates to Products offered for sale by GameRascal. For information concerning the condition of Goods offered for sale to GameRascal refer to section [7.5 Required Specifications].

5.1.2 All Products offered for sale on the Website are pre-owned. Most items have been used before coming into our possession, although some collectors’ items, for example, may never have been removed from their original packaging except for photographic purposes. It is the nature of this market, therefore, that the condition of Products may vary between individual samples. We provide information concerning the functionality and physical appearance of each Product in its Product Description. This is supported by more general information below.

5.2 Photographs

5.2.1 Most Products are represented by stock photographs of typical samples in Good* Condition, captioned ‘Illustration only’. The condition of the item on offer may therefore differ from that shown in the photograph(s). To ascertain the condition of the actual item for sale, please refer to its Product Description and to the tables in the following sections. Photographs not captioned ‘Illustration only’ depict the actual item for sale.

* If a photograph of a sample in good condition is unavailable, then a photograph of a differently graded sample may be substituted.

5.3 Consoles

5.3.1 All game consoles offered on the Website are fully functional.

5.3.2 All screens and motherboards are authentic. Console shells are authentic except where irreparable damage has necessitated their replacement by more recently manufactured shells. Similarly, scratched or otherwise damaged screen protectors may have been replaced by new products.

5.3.3 All Collectables remain in the condition in which we received them: no repairs are attempted on Collectables.

5.3.4 The condition of each console is displayed as either ‘As New’, ‘Very Good’, ‘Good’ or ‘Acceptable’ as defined in the table below. The appropriate grade is stated in the Product Description, which may also present a more detailed appraisal of the item’s condition.

As New Condition

The console screen and casing have no scratches or marks. The item is in pristine condition.

Very Good Condition

The console screen has no scratches. The inner and outer casing are in great condition with very little/superficial small scratches or scuffing.

Good Condition

The console screen may be scratched. The inner and outer casing may show little to moderate signs of wear including (but not limited to) noticeable scuff marks; scratches.

Acceptable Condition

The console screen may be scratched. The inner and outer casing may show significant signs of wear including (but not limited to) noticeable scuff marks; deep scratches.

5.4 Game Cartridges

5.4.1 All game cartridges offered on the Website are fully functional and authentic.

5.4.2 The condition of each cartridge is displayed as either ‘Good’ or ‘Acceptable’ as defined in the table below. The appropriate grade is stated in the Product Description, which may also present a more detailed appraisal of the item’s condition.

Good Condition

The cartridge may show little to moderate signs of wear including (but not limited to) minor scuff marks; superficial scratches; small creases and/or small tears in the label.

Acceptable Condition

The cartridge shows significant signs of wear including (but not limited to) noticeable scuff marks; deep scratches; ink marks; deep creases and/or large tears in the label; missing label.

5.5 Boxed Games

5.5.1 All boxed games offered on the Website are fully functional and authentic.

5.5.2 The condition of each box is displayed as either ‘As New’, ‘Good’ or ‘Acceptable’ as defined in the table below. The appropriate grade is stated in the Product Description, which may also present a more detailed appraisal of the item’s condition.

As New Condition

The box is in pristine condition. If the box is unsealed, then the condition of its contents have been verified to be in as-new condition. If the box is sealed, then its contents are assumed to be in as-new condition, but no checks have been made (this is because many collectors prefer the seal to remain intact).

Good Condition

The box opens & closes properly and the manual is intact. The cartridge, box and manual may each show little to moderate signs of wear including (but not limited to) minor scuff marks; superficial scratches; small creases; small tears.

Acceptable Condition

The box may have become squashed. The cartridge may show moderate signs of wear including  (but not limited to) minor scuff marks; superficial scratches; small creases & tears in the label. The box and manual may each show significant signs of wear including  (but not limited to) noticeable scuff marks; deep scratches; ink marks; deep creases; large tears.

5.6 Instruction Manuals

5.6.1 Manuals are offered with all boxed games and with some unboxed games. Unless otherwise stated in the Product Description, all manuals are in ‘Good’ condition as defined in the table below.

Good Condition

The manual is intact but may show small signs of wear including (but not limited to) small creases & tears.

Acceptable Condition

The manual includes all pages but some may have become detached. It shows one or more significant signs of wear including  (but not limited to) noticeable ink marks; deep creases; large tears.

5.7 Accessories

5.7.1 All accessories offered on the Website are fully functional and authentic.

5.7.2 The condition of each accessory is displayed as either ‘As New’, ‘Good’ or ‘Acceptable’ as defined in the table below. The appropriate grade is stated in the Product Description, which may also present a more detailed appraisal of the item’s condition.

As New Condition

The item and its box (where present) are in pristine condition.

Good Condition

The case or accessory may show little to moderate signs of wear including  (but not limited to) minor scuff marks and superficial scratches.

Acceptable Condition

The case or accessory shows significant signs of wear including  (but not limited to) noticeable scuff marks; deep scratches;  ink marks.

 

6 Buying from GameRascal

6.1 Service Availability

6.1.1 GameRascal accepts Orders from all countries within the European Union as well as Norway and Switzerland. GameRascal may, at its sole discretion, ship to additional countries from time to time in response to specific requests.

6.2 Product Description

6.2.1 Each Product purchased is sold subject to its Product Description. The Product Description sets out additional information related to that specific item such as its physical & operational condition and whether the associated retail box & instruction manual are offered.

6.3 Product Pricing

6.3.1 Despite our efforts, a small number of Products in our catalogue may be incorrectly priced. Rest assured, however, that we verify prices as part of our dispatch procedures. If a Product’s correct price is lower than our stated price, we charge the lower amount and refund the difference. If a Product’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order, refund the amount paid and notify you of such cancellation.

6.3.2 GameRascal is not registered for VAT and Products on the Website are not liable for VAT.

6.3.3 We reserve the right to alter all Product pricing without notice.

6.4 Product Availability

6.4.1 We make every effort to list on the Website only those Products we actually have in stock. On rare occasions, however, an error may mean that we are unable to fulfil your order at the time of purchase. We reserve the right to ship Products at a later date (up to 28 days after purchase) where the Product ordered is not in stock at the time of purchase. In this situation you will be contacted and offered a full refund instead of delivery of the Product.

6.5 The Buying Process

6.5.1 You are provided with the online equivalent of a shopping cart (‘Cart’). To add items to the Cart, click the ‘Add to Cart’ button which is displayed next to the price of the desired Product. You can remove items from your Cart, and change item quantities, on the Shopping Cart page found by clicking the ‘Cart’ link shown at the top of each Website page.

6.5.2 When you have finished adding items to your Shopping Cart, open the Cart by clicking the ‘Cart’ link at the top of the page.

6.5.2.1 To remove an item from your cart, click the corresponding ‘trash-can’ icon.

6.5.2.2 To adjust the quantity of an item, enter the new value in the corresponding ‘Quantity’ box and then click the ‘Update’ button.

6.5.2.3 To estimate your shipping costs, select your country from the drop-down list. This will display the cost of the default delivery method, but you will be able to choose a different delivery method later on (see below).

6.5.3 When you are ready to pay, click the ‘Checkout’ button which is displayed near the bottom of the page. You will then be asked to fill-in your delivery details.

6.5.3.1 Enter the address which you would like to appear on the Invoice. You may also enter a Delivery Address if it is different from the Invoice Address. If you leave the Delivery Address blank then your items will be sent to your Invoice Address.

6.5.3.2 You may enter any special instructions for GameRascal or the postman, for example, in the box provided.

6.5.3.3 Remember to tick the box confirming that you have read and agreed to our Terms & Conditions.

6.5.3.4 If you would like us to store your Delivery Details in a cookie (a small file on your computer) then tick the corresponding box. This cookie will only store the details you have entered on this page (your payment details will be securely collected by our Payment Service Provider later on: GameRascal will neither see nor store your Payment Details).

6.5.3.5 If you would like us to send you occasional emails regarding GameRascal News such as forthcoming Sales then click the corresponding box. Newsletters will be sent no more than once per month, and you can easily unsubscribe by clicking the link at the bottom of each email.

6.5.4 After entering your delivery details and confirming that you have read and agreed to these Terms and Conditions, click the ‘Checkout’ button which is displayed near the bottom of the page.

6.5.4.1 Select the desired delivery method by clicking the corresponding radio button (the small circle displayed to the left of each option). Check the displayed total, and click the ‘Checkout’ button which is displayed near the bottom of the page. You will be redirected to our Payment Service Provider’s secure website where you can complete the payment process. Afterwards, you will automatically return to the GameRascal website where you can see a summary of your Order.

6.5.5 Following successful payment, we will send you an Order Acknowledgement email detailing the Products you have ordered. The Order Acknowledgement will include a link to the web page where you can check the status of your Order. Note that this Order Acknowledgement is not an acceptance by us of your Order.

6.5.4 During the course of processing your Order, you may receive one or more further emails from us indicating the status of your Order.

6.5.5 Order acceptance and the completion of the Purchase Contract between you and us will take place on the dispatch to you of the Products ordered unless we have notified you that we do not accept your Order, or you have cancelled it in accordance with these Terms and Conditions (see Cancellation Policy, below).

6.6 Order Rejection

6.6.1 Non-acceptance of an Order may be a result of one of the following:

6.6.1.1 we were unable to obtain authorisation for your payment; or

6.6.1.2 a pricing or Product Description error was identified; or

6.6.1.3 the Product you ordered is out of stock; or

6.6.1.4 you did not meet the eligibility to order criteria set out in these Terms and Conditions.

6.6.2 GameRascal reserves the right to cancel Orders at our discretion. If we cancel an Order, it will be without charge to you.

6.7 Language

6.7.1 The ordering process will be carried out in English.

6.8 Payment Policy

6.8.1 Payment Methods Accepted

6.8.1.1 We accept Visa, Visa Electron, MasterCard, Maestro and PayPal.

6.8.1.2 All payments are handled via the secure website of our Payment Service Provider, Sage Pay.

6.8.2 When to Pay

6.8.2.1 You will be prompted to make full payment immediately after you’ve placed your Order. Goods will not be dispatched until GameRascal has received cleared payment in full.

6.8.2.2 If you are unable to pay for your Order within one hour of placing it then your Order will be automatically cancelled and the goods returned to GameRascal’s stock.

6.8.3 How To Pay

6.8.3.1 At the appropriate point during the ordering process you will be automatically redirected to the secure website of our Payment Service Provider, Sage Pay. Follow the instructions on their website to submit your payment. Following successful payment, or if you choose to cancel before paying, you will automatically return to the GameRascal website.

6.9 Order Tracking

6.9.1 Once you have successfully placed your Order and received an Order Acknowledgement from us you are able to track its progress by accessing the web page indicated in your Order Acknowledgement. You will be required to enter your email address and Order Number. The Order Number is given in your Order Acknowledgement. You will receive an email confirmation when your items have been dispatched (‘Dispatch Confirmation’).

6.10 Delivery Policy

6.10.1 Locations

6.10.1.1 All items are shipped from the United Kingdom.

6.10.1.2 We ship to all European Union member states, as well as Norway and Switzerland. GameRascal may, at its sole discretion, ship to additional countries from time to time in response to specific requests.

6.10.2 Safe Place If Recipient Not At Home

6.10.2.1. We will normally instruct the carrier to return your parcel to GameRascal in the event that it cannot be delivered to the addressee. If you would prefer the parcel to be left with a neighbour or left in a secure location, for example, then please leave instructions in the ‘Special Instructions’ section of the online Shopping Cart during checkout.

6.10.3 Time-scales and Rates

6.10.3.1 Last Order Times

6.10.3.1.1 We aim to dispatch most orders received before 2pm on the same day (Monday to Friday), although it may take longer during busy periods.
6.10.3.1.2 Orders using the Next Day services must be placed before midday (London UK time).

6.10.3.2 Delivery to United Kingdom

6.10.3.2.1 We offer a number of delivery services as set out in the table below. Our delivery rates include postage & packing.
6.10.3.2.2 The time-scales shown are those estimated by the carrier. GameRascal cannot guarantee time-scales. Read about Late and Lost In Transit Deliveries.

6.10.4 Late and Lost in Transit Deliveries

6.10.4.1 If you have not received your Order within the expected time-frame, please contact us.

6.10.4.2 In the unlikely event that an Order is lost during shipment, we will attempt to source a replacement to dispatch to you. If this is not possible we will refund you the value of the missing item(s) to the card used for original payment. The value refunded will be equal to the value taken for original payment of the item(s), and will not reflect any price changes which have since occurred.

6.11 Cancellation Policy

6.11.2 Right to Cancel

6.11.2.1 You have the right to cancel this contract within 14 days without giving any reason. GameRascal gives you additional rights should your goods develop a fault within 30 days: please refer to the GameRascal Warranty for details.

6.11.2.2 The cancellation period will expire after 14 calendar days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

6.11.2.3 To exercise your right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g.  an email sent to customersupport@gamerascal.co.uk; or a letter sent by post to: GameRascal (Cancellations), 55 Swan Road, London SE16 7DY). You may use our model cancellation form, which can be downloaded from http://www.gamerascal.co.uk/cancelform.pdf, but it is not obligatory. If you do not use our model cancellation form then please provide GameRascal with as many of the following details as possible: Order ID, Order Date or Date Received, Customer Name & Address, Date Order Cancelled.

6.11.2.4 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

6.11.3 How much will be reimbursed?

6.11.3.1 If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

6.11.3.2 We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

6.11.4 When and how will I be reimbursed?

6.11.4.1 We will make the reimbursement without undue delay, and not later than:

(a) 14 calendar days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 calendar days after the day you provide evidence that you have returned the goods, or
(c) 14 calendar days after the day we expressly agree to waive your obligation to return the goods, or
(d) if there were no goods supplied, 14 calendar days after the day on which we are informed about your decision to cancel this contract.

6.11.4.2 We will issue the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

6.11.4.3 When we issue the reimbursement we will send you an email confirming this. If you paid by credit card or debit card then your card issuer may take a few days to process the reimbursement: this is outside of our control and you should contact your card issuer before contacting GameRascal if you do not receive the reimbursement when expected.

6.11.5 Returning Goods to GameRascal

6.11.5.1 Please return the goods without undue delay and in any event not later than 14 calendar days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 calendar days has expired. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

6.11.5.2 You will have to bear the cost of returning the goods in the case of cancellation. Prior to GameRascal receiving such goods the risk of loss and title for such goods remains with you. As such, we recommend that when sending goods to us you use an insured and/or traceable method of transit, such as Royal Mail Signed For. We will not issue refunds for any goods lost or stolen in transit to us. Where a return is lost or stolen in transit to us, you should claim compensation from the company that shipped the return.

6.11.5.3 Please return the goods to: GameRascal (Returns), 55 Swan Road, London SE16 7DY. You should enclose your name, address, email address and Order Number.

6.12 Buyer’s Warranties

6.12.1 The Buyer represents and warrants that:

6.12.1.1 the Buyer’s Information is true and accurate in any and all respects; and

6.12.1.2 the purchase will not cause GameRascal to breach any applicable law of the United Kingdom or any other country including but not limited to anti-money laundering law; and

6.12.1.3 the Buyer is legally capable of entering into binding contracts; and

6.12.1.4 the Buyer is eighteen (18) years of age or older; and

6.12.1.5 The Buyer will not impersonate any other person or entity or use a false name or a name that he is not authorised to use.

6.13 GameRascal’s Warranty

6.13.1 The Warranty Period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

6.13.2 Within the Warranty Period, GameRascal warrants the Buyer that the product is fully operational unless one of the limitations listed below is in effect:

6.13.3 Limitations:

6.13.3.1 Our warranty is not applicable to Products which are used commercially;

6.13.3.2 Our warranty does not become effective if the defect was caused by the buyer and/or a third person:

(a) handling the Product negligently; or
(b) having used the Product incorrectly or together with Products not produced or licensed by Nintendo™ (e.g. non-licensed game accessories, copiers, adaptors or power packs); or
(c) having modified it or having attempted to repair it; or
(d) having used it in disagreement with the manual published by the manufacturer.

6.13.3.3 Our warranty does not cover any limitations to Product functionality specifically referred to or described in the Product Description on our Website.

6.13.3.4 Our warranty does not cover a degradation of a rechargeable battery appearing over the course of time.

6.13.3.5 Our warranty does not cover physical damage, water damage, or software faults.

6.13.4 How to Claim

6.13.4.1 Please do not return the product until we have expressly agreed to this.

6.13.4.2 To make a claim under our warranty, you must inform us of your claim by sending an email to customersupport@gamerascal.co.uk. Please include your Order Number and a brief description of the defect.

6.13.4.3 To meet the warranty deadline, it is sufficient for you to send your communication concerning your exercise of the right to claim under the warranty before the warranty period has expired.

6.13.5 What Happens Next?

6.13.5.1 We will contact you to discuss the product defect and the options available:

6.13.5.2 If GameRascal at its absolute discretion chooses to refund you for the product without its being returned to us then we will reimburse to you all payments received from you for the defective product, including the incremental costs of delivery of this product (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

6.13.5.3 If GameRascal at its absolute discretion agrees that the product may be returned to us under this warranty then we will send you an email containing a Returns Reference Number and an address to which the product may be returned (see Returning Products, below).

6.13.6 Returning Defective Products

6.13.6.1 You should return the defective product to the address provided by GameRascal for this express purpose within 14 calendar days from the day after you received the Returns Reference Number and Return Address from GameRascal.

6.13.6.2 The product should be packaged in such a way as to prevent damage during transit to GameRascal.

6.13.6.3 Prior to GameRascal receiving such products the risk of loss and title for such products remains with the customer. As such, we recommend that when sending items to us you use an insured and/or traceable method of transit, such as Royal Mail Recorded Delivery. We will not issue refunds for any products lost or stolen in transit to us. Where a return is lost or stolen in transit to us, you should claim compensation from the company that shipped the return.

6.13.6.4 Products returned to us under this warranty will be fully tested to verify the fault. Should a product not be found to be defective then it will be returned to you. Should a product be confirmed by us to be defective, then:

6.13.6.4.1 We will reimburse to you the cost of standard or recorded postage incurred returning the product to us. Please note that we will not refund any courier, overnight or express element of any delivery or postage charge such as Royal Mail Special Delivery;
6.13.6.4.2 We will seek to repair the product and return it to you. Repairs can take up to 28 days. If no repair can be made, we will send a replacement product if one is available. If no replacement can be issued, we will reimburse to you all payments received from you for the defective product, including the incremental costs of delivery of this product (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

6.13.7 Reimbursements

6.13.7.1 We will make the reimbursement without undue delay, and not later than 14 calendar days after we have agreed to refund the product;

6.13.7.2 We will issue the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

6.13.7.3 When we issue the reimbursement we will send you an email confirming this. If you paid by credit card or debit card then your card issuer may take a few days to process the reimbursement: this is outside of our control and you should contact your card issuer before contacting GameRascal if you do not receive the reimbursement when expected.

6.13.8 General

6.13.8.1 Other claims against GameRascal are excluded from this warranty; moreover, no claims can be made within this warranty for damages compensation.

6.13.8.2 This warranty is granted additionally to possible legal warranty claims which the Buyer as a consumer is entitled to have.

7 Selling to GameRascal

7.1 Service Availability

7.1.1 GameRascal accepts Sales Enquiries from within the United Kingdom only.

7.2 The Sales Process

7.2.1 To receive a Quotation, the Seller should complete and, having read and understood these Terms and Conditions in full, submit a Sales Enquiry. On receipt of a Submitted Sales Enquiry, GameRascal may (but is not obliged to) send to the email address provided by the Seller a Quotation based on the information provided in the Submitted Sales Enquiry. The Quotation will be issued within two Working Days following the date of the Submitted Sales Enquiry.

7.2.2 Neither GameRascal’s submission of, nor the Seller’s receipt of, a Quotation is a contractual offer, nor is a Quotation itself a contractual offer; it merely indicates the price GameRascal may (but is not obliged to) pay for the Goods. Any Quotation is given on the basis that a binding contract shall only come into existence in accordance with Conditions [7.2.10] or [7.2.14.2].

7.2.3 The Quotation will contain:

7.2.3.1 an indication of the price GameRascal may (but is not obliged to) pay for the Goods; and

7.2.3.2 a request for the Seller, if he so chooses, to provide the Seller’s Payment Details to GameRascal; and

7.2.3.3 a postal address to which the Seller, if he so chooses, may post the Goods to GameRascal.

7.2.5 The provision by the Seller of the Seller’s Payment Details to GameRascal and the posting by the Seller of the Goods to GameRascal shall together constitute an offer by the Seller to enter into a binding contract with GameRascal (‘Sale Offer’), which GameRascal is free to accept or decline at its absolute discretion .

7.2.6 If the Seller posts his Goods to GameRascal then he does so entirely at his own risk and, subject to Condition [8.3], GameRascal does not accept any liability for loss of, damage to or delay to the arrival of the Goods. The Seller may, at his own cost, send the Goods to GameRascal by Royal Mail Special Delivery or other insured courier. GameRascal will endeavour to record receipt of all incoming post and any such record shall be final evidence of the date the Goods were received by GameRascal.

7.2.7 The Quotation shall only remain valid for a period of ten (10) calendar days from the date GameRascal sends the Quotation unless GameRascal notifies the Seller in writing that it has changed or withdrawn the Quotation during this period.

7.2.8 GameRascal shall under no circumstances whatsoever at any time be obliged to purchase the Seller’s Goods whether in connection with any Quotation, any Counter-Proposal or absence thereof, or otherwise, nor shall GameRascal be liable for any loss suffered by the Seller as a result of any Sale, lack of Sale or otherwise.

7.2.9 On receipt of the Goods, GameRascal shall:

7.2.9.1 check whether the Goods were received within ten (10) calendar days of the date of the Quotation; and

7.2.9.2 carry out an Inspection.

7.2.10 If the Goods were received within ten (10) calendar days of the date of the Quotation and, following Inspection, GameRascal is willing to proceed with the Sale, GameRascal shall arrange payment to the Seller in accordance with Condition [7.4]. A Sale Contract shall only commence on payment by GameRascal to the Seller. Ownership of the Goods will only pass to GameRascal on payment to the Seller.

7.2.11 GameRascal may (at its absolute discretion) reject the Sale Offer if, following Inspection, GameRascal (at its absolute discretion) considers that:

7.2.11.1 the Condition of the Goods is such that the Goods are beyond economical repair; or

7.2.11.2 the Goods do not meet the Required Specifications; or

7.2.11.3 the Goods received are not a genuine version, or are a counterfeit version of the make and model described in the Submitted Sales Enquiry; or

7.2.11.4 the Goods received are of Nil value, on the date GameRascal receives the Goods from the Seller.

7.2.12 GameRascal may (at its absolute discretion) reject the Sale Offer and/or make a Counter-Proposal in accordance with Condition [7.2.14] if:

7.2.12.1 the Goods are received more than ten (10) calendar days after the date of the Quotation;

7.2.12.2 or if the Goods received do not include all of the items on which the Quotation was based;

7.2.12.3 or if, following Inspection, GameRascal (at its absolute discretion) considers that:

7.2.12.3.1 the condition of the Goods does not warrant the Quotation due to cosmetic or functional damage and/or general wear and tear; or
7.2.12.3.2 the Goods are not the same make or model as stated in the Submitted Sales Enquiry; or
7.2.12.3.3 the Seller’s Information is not true and accurate in any and/or all respects.

7.2.13 Any rejection or Counter-Proposal made by GameRascal pursuant to Conditions  [7.2.11] or [7.2.12] will be sent to the Seller using the e-mail address provided in the Submitted Sales Enquiry.

7.2.14 Counter-Proposals

7.2.14.1 On informing the Seller of the Counter-Proposal (if any), GameRascal will request the Seller to confirm, within five (5) calendar days of the date of the Counter-Proposal, his acceptance or rejection of the Counter-Proposal.

7.2.14.2 If the Seller confirms within five (5) calendar days of the date of the Counter-Proposal that he wishes to proceed with the Sale on the basis of the Counter-Proposal then GameRascal shall arrange payment to the Seller in accordance with Condition [7.4]. A Sale Contract shall only commence on payment by GameRascal to the Seller. Ownership of the Goods will only pass to GameRascal on payment to the Seller.

7.2.14.3 If the Seller, within five (5) calendar days of the date of the Counter-Proposal, rejects the Counter-Proposal:

7.2.14.3.1 GameRascal will request payment from the Seller of £5.00 (the ‘Returns Fee’) for the Goods to be returned to him. This Return Fee of £5.00 is to cover GameRascal’s cost of sending the Goods back to the Seller by recorded delivery thus ensuring a safe return.

7.2.14.3.2 GameRascal must receive the Returns Fee in cleared funds within twelve (12) calendar days of the date of GameRascal’s payment request to the Seller before sending the Goods back to the Seller. Subject to Condition [8.3], GameRascal does not accept any liability for any loss suffered by the Seller in relation to the return of the Goods.
7.2.14.3.3 If the Seller fails to make payment in accordance with clause [7.2.14.3.2] the Counter-Proposal will be deemed as accepted by the Seller and payment will be made in accordance with clause [7.4].

7.2.14.4 Counter-Proposal orders will be automatically processed for payment if:

7.2.14.4.1 the Seller does not reply to GameRascal’s proposed offer email within 5 calendar days or
7.2.14.4.2 where the Returns Fee does not show as cleared funds in GameRascal’s account in accordance with clause [7.2.14.3.2].

7.2.15 Sale Offer Rejections

7.2.15.1 On informing the Seller of the rejection (if any), GameRascal will request payment from the Seller of £5.00 (the ‘Returns Fee’) for the Goods to be returned to him. This Return Fee of £5.00 is to cover GameRascal’s cost of sending the Goods back to the Seller by recorded delivery thus ensuring a safe return.

7.2.15.2 GameRascal must receive the Returns Fee in cleared funds within twelve (12) calendar days of the date of GameRascal’s payment request to the Seller before sending the Goods back to the Seller. Subject to Condition [8.3], GameRascal does not accept any liability for any Loss suffered by the Seller in relation to the return of the Goods.

7.2.15.3 If the Seller fails to make payment in accordance with clause [7.2.15.2] title to the Goods will pass to GameRascal and GameRascal will decide (at its absolute discretion) how to dispose of the Goods.

7.2.15.4 Title to the Goods will pass to GameRascal if:

7.2.15.4.1  the Seller does not reply to GameRascal’s rejection email within 5 calendar days or

7.2.15.4.2 where the Returns Fee does not show as cleared funds in GameRascal’s account in accordance with clause [7.2.15.2].

7.3 Language

7.3.1 The Sales Process will be carried out in English.

7.4 Payments

7.4.1 Any payments to be made by GameRascal to the Seller shall be made in accordance with the Seller’s Payment Details provided by the Seller.  Such submitted details shall be final and may not be changed after they have been submitted.

7.4.2 Cash Payments

7.4.2.1 Any Cash Payments to be made by GameRascal to the Seller shall be made via PayPal, bank transfer or cheque.

7.4.2.2 GameRascal will only make a PayPal payment to the Seller using the email address provided by the Seller in the Sales Enquiry.

7.4.2.3 GameRascal will only make a cheque payable to the Seller named in the submitted Seller’s Payment Details and post such cheque to the address given in the submitted Seller’s Payment Details.

7.4.2.4 GameRascal will reissue damaged or lost cheques at the request of the Seller but reserves the right to deduct an administrative fee of £10.00 for doing so. This is to cover the cost of stopping the original cheque.

7.4.2.5 GameRascal will only make a bank transfer using the account details (which must bear the Seller’s name) given in the submitted Seller’s Payment Details.

7.4.2.6 GameRascal will not under any circumstances recall or reissue bank transfer or PayPal payments once made.

7.4.4 For the avoidance of doubt the Seller warrants that all information provided to GameRascal is truthful and accurate and without error or omission. The Seller is wholly responsible for ensuring all information provided by him to GameRascal within a Submitted Sales Enquiry and submitted Seller’s Payment Details is truthful and accurate. GameRascal cannot be held liable for whatsoever reason for any error or omission in the information provided by the Seller to GameRascal.

7.5 Required Specifications

7.5.1 Authenticity

7.5.1.1 All Goods offered for sale to GameRascal must be authentic, with the following singular exception: it is permissible for consoles to include in their construction non-electronic components (including but not limited to console shells and screen protectors) which have been produced by manufacturers other than those of the corresponding original components. The inclusion of any such components must be disclosed in the Sales Enquiry.

7.5.2 Physical Condition

7.5.2.1 Games offered for sale to GameRascal must:

  • be fully functional (exception: a non-saving Pokémon game is acceptable provided that it is fully functional in all other respects); and
  • be fully intact; and
  • not have sustained crush or water damage or excessive cosmetic damage and/or wear and tear; and
  • be of European or United Kingdom specification.

7.5.2.2 Consoles offered for sale to GameRascal must:

  • have no dead pixels; and
  • be fully functional except where disclosed in the Seller’s Information; and
  • be fully intact; and
  • not have sustained crush or water damage or excessive cosmetic damage and/or wear and tear.

7.5.2.3 Game Boy Advance SP consoles offered for sale to GameRascal must have undamaged screens with no scratches, pits, dust particles or other blemishes which cannot easily be removed without dismantling the console.

7.5.2.4 Boxed items offered for sale to GameRascal must include the corresponding instruction manuals.

7.6 Cancellation Rights

7.6.1 Sellers have the right to withdraw from the Sales Process at any point up to the Sale Offer or, where a Counter-Proposal has been made, at any point up to five (5) calendar days from the date of the Counter-Proposal.

7.7 Seller’s Warranties

7.7.1 The Seller represents and warrants that:

7.7.1.1 the Seller’s Information is true and accurate in any and all respects; and

7.7.1.2 the Seller is the registered and legal owner of the Goods; and

7.7.1.3 the Seller has the right to transfer in full the unencumbered legal title and full ownership of the Goods to GameRascal and the Goods are not subject to any outstanding or potential debts or any other liability associated with the Goods whether at law, in equity, possessory or otherwise; and

7.7.1.4 the Goods do not suffer from any physical defects or problems that have not been disclosed in the Submitted Sales Enquiry; and

7.7.1.5 the Seller’s possession of the Goods does not result from any illegal activity in the United Kingdom or in any other country; and

7.7.1.6 the Sale will not cause GameRascal to breach any applicable law of the United Kingdom or any other country including but not limited to anti-money laundering law; and

7.7.1.7 the Seller is legally capable of entering into binding contracts; and

7.7.1.8 the Seller is resident in the United Kingdom and eighteen (18) years of age or older; and

7.7.1.9 The Seller will not impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

8 General

Any reliance you place on such information is therefore strictly at your own risk.

8.3.2 In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

8.3.3 Every effort is made to keep the website up and running smoothly. However, GameRascal takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

8.4 Survival
